Farm Credit also offers on the Site a classified advertisement section for posting advertisements to offer to buy, sell or lease farm, rural and recreational real estate and to offer to buy or sell livestock, production contracts, farm equipment and other products and services related to agriculture. • IN GENERAL

• The information and descriptions of the Services provided are intended as general information and are not necessarily complete descriptions of all terms, exclusions and conditions applicable to the products and services offered by the Associations. The Associations are member-owned cooperatives which provide credit and credit-related services to or for the benefit of eligible shareholders for qualified agricultural purposes in the State of Illinois. These Associations are lending institutions of the Farm Credit System which was established by Congress to meet the credit needs of American agriculture. They are regulated by the Farm Credit Administration ("FCA"), a federal agency. Each of these Associations is authorized to provide, either directly or in participation with other lenders, credit and related services to eligible borrowers. Eligible borrowers include farmers, ranchers, producers or harvesters of aquatic products, rural residents and farm-related service businesses. The Associations that are FLCAs make secured long-term agricultural real estate and rural home mortgage loans and provide lease financing options for agricultural purposes. The Associations that are PCAs make short- and intermediate- term loans and provide lease financing options for agricultural production or operating purposes. The Associations offer various risk management services, including credit life, crop hail and multi-peril crop insurance for borrowers and those eligible to borrow. The Associations also offer fee appraisal services to persons eligible to borrow and others in accordance with FCA regulations.

  Not all products and services described in the Services are available in all geographic areas. The Associations are authorized to make loans and offer credit-related services outside the State of Illinois only in accordance with territorial concurrence regulations adopted by the FCA. Product and service availability and your eligibility for such products and services varies by your geographical location; the specific terms, conditions and requirements of the products and services; and the governing provisions of the federal Farm Credit Act and FCA Regulations. Your eligibility for particular products and services is subject to the applicable Association’s final determination and acceptance. The insurance coverage afforded by the Associations is subject to the terms and conditions of the policies issued. Services offered on the Site should not be construed as approval of a loan, lease, insurance application, or other financial service, unless you receive a written notice of approval from one of the Associations. You understand that none of the Associations is rendering legal, accounting or any other professional advice or opinions on specific facts or matters and, accordingly, none assume any responsibility whatsoever in connection with your use of or reliance on the Services.

• CLASSIFIED AD SERVICES

  As part of its Classified Ad Services, Farm Credit provides a venue in which you can advertise offers to buy, sell or lease agriculture-related assets and/or services (collectively referred to as “Classified Offerings”) or post and learn about agriculture-related employment opportunities. This is a free service. There is no charge for posting a listing on the Classified Ad Services, and Farm Credit charges no commission or fee in connection with the sale of items posted on the Classified Ad Services. To use the Classified Ad Services, you must be a resident of the United States and legally able to form binding contracts. You may not use the Classified Ad Services if you are under the age of 18. Farm Credit reserves the right to change its no-fee policy with regard to the Classified Ad Services at any time in the future without notice to you.

  Farm Credit has no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings, the ability of advertisers to advertise Classified Offerings, the ability of sellers to sell items, the ability of lessors to lease items, the ability of buyers to buy items or the ability of employers to offer job positions. Farm Credit cannot ensure that a buyer, seller or lessor will actually complete a transaction or that an employer will actually offer a job position, and Farm Credit has no control over the information provided by buyers, sellers, lessors or potential employers.

  You understand that there are risks in using the Classified Ad Services, which you assume when you use the Classified Ad Services. By posting any particular listing, Farm Credit does not endorse any aspect of the listing, including the price, contract terms, quality, safety, accuracy or legality of the Classified Offerings or advertisement that are contained in the Classified Ad Services. Since Farm Credit does not confirm the identity of buyers, sellers, lessors or employers, Farm Credit cannot guarantee that any identity is accurate. You are responsible for any applicable taxes that are incurred in buying, selling or leasing Classified Offerings through the Classified Ad Services.

  Farm Credit is not involved in the transaction between you and a buyer, seller, lessor or potential employer. If you have a dispute with one of them, you understand that none of the Associations is required to assist you in the dispute. You hereby agree to release the Associations from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with any such disputes or use of the Classified Ad Services.

  You understand that the Classified Ad Services may only be used for lawful purposes, and you have sole responsibility for ensuring that you comply with all legal requirements, including any state or federal laws, rules or regulations that regulate the advertisement or sale of any listing which you post on the Classified Ad Services. You may not make use of any unfair or false advertising technique, including without limitation, fraudulent advertisements, misleading offers that do not list the total purchase price or a “bait & switch” of goods or services. If you are involved in a transaction through the Classified Ad Services, you agree that you will not use any information provided by any party to the transaction for any purpose other than to complete the transaction.

  All real estate listed in the Classified Ad Services is subject to the Fair Housing Act. This law makes it illegal to advertise any preference, limitation or discrimination based on race, color, religion, sex, disability, familial status or national origin, or any intention to make any such preference, limitation or discrimination. Familial status includes children under the age of 18 living with parents or legal custodians; pregnant women; and people securing custody of children under 18. Farm Credit will not knowingly accept any advertising for real estate which is in violation of the law. You are hereby informed that all dwellings advertised in the Classified Ad Services are available on an equal opportunity basis.   You are allowed to upload three graphics to the Site when you post a classified ad. Items listed in the Classified Ad Services must be related to agriculture. The following items may not be offered, sold or leased through the Classified Ad Services or contained within any classified ad, including the graphics you provide:
  
  

  Alcohol Any live or stuffed animal or part thereof that is prohibited by law to be sold (e.g., stuffed migratory birds, animal pelts and skins from endangered species, marine mammal products that have not been transformed into Alaskan Native articles; ivory) Batteries that contain mercury CB Amplifiers Contracts or tickets, unless allowed by law Counterfeit currency or stamps Counterfeit items Credit cards Drugs and drug paraphernalia Explosives Firearms, ammunition and other weapons Fireworks Food, unless seller is authorized by state or federal law to sell food products Freon Goods from embargoed nations Goods that do not exist Government identification and licenses

  In addition, Farm Credit reserves the right to remove any listing or eliminate any material, graphics or information that it chooses, at any time and for any reason, without notice or liability to you or any third party.

• INTEREST RATE NOTIFICATION SERVICE (“RATE ALERT SERVICE” or “RATE QUOTE SERVICE”)

  As part of the Services offered through the Site, you may have the opportunity to register your request that an Association contact you if an interest rate on certain loan or lease products offered by an Association reaches or approximates the rate specified by you (“Rate Alert Service”) or what interest rates are currently available (“Rate Quote Service”). >The Rate Alert Service and the Rate Quote Service are available only on certain agricultural loan and lease products and loan products for certain rural residences. To qualify to use these services, you must be a United States farmer, rancher, or a rural resident in open country within a state of the United States, which may include a town or village that has a population of not more than 2,500 persons. If you qualify and utilize these services, one of the Associations will use its commercially reasonable efforts to have one of its representatives contact you within a reasonable period of time after the interest rate on one of the available products reaches or approximates the rate specified by you within twelve (12) months of the date that you make your request. The Associations may contact you by email, telephone or regular mail at the address or telephone number you provide when you contacted us. Rate requests made by you expire one year after the date you make your request. This is a manual process, and your request is not tracked by computer; therefore, you should not rely on either of these services as your exclusive method for monitoring interest rates. As a condition of using these services, each of the Association’s liability to you is limited as set forth elsewhere in these Terms and Conditions. If an Association notifies you of an interest rate, you understand that it is not obligated to hold the rate at this level for you for any period of time. You further understand that by the Association’s notifying you of a particular rate, you have not been approved for a loan or lease nor is there any guarantee that you will qualify for a loan or lease or for this interest rate. The Rate Alert Service and Rate Quote Services are not loan or lease applications, nor loan or lease approvals.

• INFORMATION CENTER SERVICES

  You assume total responsibility and risk for your use of the Information Center Services. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all information provided in the Information Center Services.

• ONLINE BANKING SERVICES

  If you have Association accounts and wish to access them or transfer funds to or from your accounts through this Site or otherwise make use of any online banking services (“Online Banking Services”), you must also enter into written agreements with the Association, including an Electronic Fund Transfer Agreement and Disclosures. These transactions are subject to the provisions of such agreements in addition to the Terms and Conditions of this Site and AgriBank, FCB’s site. Please be aware that when you access the Online Banking Services you are linking to a web site owned by AgriBank, FCB. You are no longer on Farm Credit’s Site.

• Impersonate another person or entity, including without limitation, a representative of Farm Credit or its officers, directors, employees or agents, falsely represent or misrepresent your affiliation with another person or entity, or forge headers or otherwise manipulate identifiers that would disguise the origin of any Content transmitted through the Site or Services.

• Collect or store personal data with respect to third parties except as contemplated by the Terms and Conditions and then only for the express purpose of providing lawful communication that may reasonably be anticipated by such third parties.
• Directly or indirectly, intentionally disrupt or interfere with the Site or Services in any manner that may materially adversely affect Farm Credit, you or any third party.>
• Upload, post, email or otherwise transmit any material that contains software viruses or any other code, files or programs designed or known to disable, interrupt, or limit the functionality of any computer hardware, computer software, or telecommunications equipment or facilities.
• Upload, post, email or otherwise transmit without authorization any material that contains personal or private information concerning any third party person or entity, including without limitation, phone number(s) or addresses, credit/debit cards, calling cards, account numbers, social security numbers, passwords or other similar information.

Farm Credit reserves the right to terminate your use of the Services in appropriate circumstances if you infringe upon the intellectual property rights of any third party.
